Terms of Service

The agreement between you and the operator of Rememb. Plain-English summary: you buy a license to use the software, we provide it, Polar handles payment.

These Terms of Service ("Terms") govern your use of Rememb, a Windows activity-tracker application operated by Oleh Kolega ("we", "us", "the operator"). By installing, copying, or otherwise using Rememb, you agree to these Terms.

If you do not agree, do not install or use Rememb. If you have already purchased a license and disagree with these Terms, contact us within 14 days of purchase for a refund.

Your license

When you purchase Rememb, we grant you a non-exclusive, non-transferable license to install and use the software on the number of Windows machines specified by your tier. The 1-device tier permits one activation; the 3-devices tier permits three activations. Each activation is tied to one machine.

You may deactivate a machine at any time from within the application or by emailing us. Deactivation frees the slot so you can move your license to another machine.

Permitted use

You may use Rememb to track your own activity on machines you own or control. You may export your data and use it for personal or business purposes (time tracking, billing, self-review).

Prohibited use

You may not use Rememb to track the activity of another person without their informed consent, or to violate any applicable law. You may not reverse engineer, decompile, or disassemble the software except to the extent expressly permitted by applicable law. You may not resell, rent, lease, or sublicense your license key.

Payment and refunds

Payment is processed by Polar, our merchant of record. Polar handles VAT, sales tax, and billing-currency conversion in line with the laws of your country. By purchasing, you also agree to Polar's terms, available at polar.sh.

Because Rememb is digital software delivered instantly, all sales are final once a license key has been issued. If you have not yet activated your key, contact us within 14 days of purchase for a full refund. Refund requests after activation are handled case-by-case at our discretion.

License check and offline use

Rememb performs a license-activation check when you first launch it and periodically thereafter. You may use the software offline for up to 30 days between license checks. If the offline grace period expires without a successful check, the software will stop working until it can verify your license.

Updates

We may release updates that add features, fix bugs, or improve performance. Updates are included with your license at no additional cost. We do not guarantee that any specific feature will be available in any specific future release.

Disclaimer of warranty

Rememb is provided "as is" and "as available", without warranty of any kind, express or implied, including but not limited to the warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the software will be uninterrupted, error-free, or that it will meet your specific requirements.

Limitation of liability

To the maximum extent permitted by law, the operator of Rememb shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation loss of profits, data, use, or goodwill, resulting from your use of (or inability to use) the software. Our total liability for any claim arising under these Terms shall not exceed the amount you paid for your license.

Termination

You may stop using Rememb at any time and uninstall the software. We may revoke your license if you materially breach these Terms — for example, by sharing your license key publicly or by using the software in violation of the Prohibited Use section. If we revoke your license, we will issue a refund prorated to the time remaining in any offline grace period, at our discretion.

Governing law

These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict-of-laws principles. Any dispute arising from these Terms will be resolved in the courts of Delaware, except where mandatory consumer-protection laws of your country of residence give you the right to bring proceedings in your local courts.

EU and UK consumer rights

If you are a consumer in the European Economic Area or the United Kingdom, mandatory local consumer-protection laws apply alongside these Terms. Nothing in these Terms removes or limits your statutory rights, including the right of withdrawal under EU consumer law where applicable, and the right to remedies for non-conforming digital content.

You may also refer any dispute to the European Commission's online dispute-resolution platform at ec.europa.eu/consumers/odr.

Changes to these Terms

If we make a material change to these Terms, we will update the "Last updated" date at the top of this page and may surface a notice inside the Rememb application on next launch. Continued use of Rememb after a material change constitutes acceptance of the updated Terms.
